Same Sex “Marriage” is a Political Ploy. Civil union for all couples, is the equitable solution.

Posted by in America
Changing the definition of the word "Marriage",  is pursued by activists and Politicians who want to win power, not do what's best for the people.  Neither side's goal is an equitable solution.
The issue is useful for scaring people into contributing funds, attracting and/or retaining voters and it keeps government benefit costs down.   Politically aligned gay activists want to keep their rabble rousing jobs going indefinitely.  Politically speaking, this issue is extremely useful to both parties.   Politicians have no motivation to change the status quo.   Stirring up controversy is good for their business.
These questionable motivations are antithetical to the interests of same sex couples waiting for legal stature.

The primary motivation of most same sex individuals, who wish to live as a couple (co-join their finances and live together), is to achieve legal rights to estate, medical visitation, government benefits etc., on par with heterosexual couples, which would be recognized by every state.
The issue is not that two people who love each other can't get married and live together.    Anyone can get "married" without government approval.  The issue is giving legal status to individuals in a same sex union.  It is about the Marriage Contract, not marriage itself.

A government issued "marriage" certificate is a secular document to track unions for legal and practical purposes.  Using the terminology 'marriage' is misleading and can even be viewed as the government imposing a religion or interfering with the right to association of same sex couples.
People are mistaken in framing the issue as being about the morality of a same sex union.

A domestic/civil union is not about sex!   It is a legal document outlining family, financial and access arrangements.  It is neither a moral judgment nor justification for homosexuality.  Giving legal status to same sex domestic/civil unions, therefore, does not promote or legitimize homosexuality.  Refusing to give legal status to partners in a domestic union will not diminish homosexuality either.  In fact, due to the publicity of the refusal to give legal status,  it increases awareness of Homosexuality, which is exactly what the Gay activists want.
The most equitable and practical solution
Remove the word "Marriage" from all civil documents.  All couples, Heterosexual or Homosexual, would be called "Civil Unions", with equal legal rights.   Restrictively define a Domestic or Civil Union as a "union of two individual human beings, not already in another union and not directly related", so that it cannot become polygamy, bestiality, incest or a work around for inheritance tax.

Use of the word "Marriage" would be solely in the domain of religious authorities.  Only the clergy would be able to perform marriages.  Both the clergy and civil authorities can issue a Civil Union license.  If a gay church wants to perform a marriage or ceremony the government has no right to interfere.  This separates marriage as a private matter, where it belongs.
The word "Spouse" comes from the root to pledge or solemnly promise.  If acceptable, the word "Spouse" can apply also to those pledged in a civil union.   If that is not acceptable, pass temporary legislation to equate the word “spouse” and “Civil Union partner” for legal purposes (such as insurance coverage, social security, military benefits, pensions, medical leave, inheritance, divorce, hospital visitation etc.) until the wording can be changed in all civil documents.
Other solutions?
Issuing both civil union and marriage certificates would create two classes of citizens and foster conflict.  Everyone can be treated equally by 'Civil Union" wording.  Changing, expanding or overturning the definition of marriage causes conflict.  Using the wording "Civil Union"  bypasses conflictIn the USA. "Marriage" by legal definition and according to common law, precedent, tradition, Religious belief, Federal and State DOMA (defense of marriage acts) and State Constitutional amendments is considered as solely a union between one man and one woman.
By this legal definition, same sex “marriage” is contradiction in terms. It makes as little sense as allowing for a Male “Lesbian”. By the same token, of legal entrenchment,  overturning the definition of marriage entirely, to also apply to same sex couples, is quite impractical compared to the mere changing of the wording of a license.  Privatizing by removing the marriage contract completely from government and relying on individual contracts is problematic as long as there are government benefits involved, and recognition by all state governments.

Getting around Politics
Change only comes, (until we fix this broken system where parties rule), when the rulers interests are served.  They want money,  power and votes.  So which party will make this happen?  Perhaps, counter intuitively, this is a winning opportunity for the Republican party.  If they initiate this legislation, it would sway the many, well to do, fiscally conservative, previously alienated gay and gay supporting voters back to the Republican party and it would not alienate the Religious Right, because the definition of marriage remains the same.

The Democrats have every incentive not to bring up this legislation and risk losing a lock on Gay voters.  If the Democrats are forced to bring up a bill, the Democrats will craft wording that is in some way abhorrent to Republicans.  In that manner the bill will be killed and blamed on the Republicans.  Same sex couples will still be out in the cold.

There is no Right to Health or Health care

Posted by in America
Health care is not a right, it is a responsibility of the person and the doctor; the person to maintain their health and the Doctor to take care of patients.
See how much good it will do to tell the AIDS virus, Cancer, heart disease and your cold virus about a right to health!

Health insurance falls under the right to liberty. You have the liberty to purchase insurance.  But there is no right to have someone else provide it for you for “free”.
First of all there is no such thing as Free!   Free is paid for by someone.
This message is encoded in the Semitic roots of language.  The word ‘free’ (CHiNam) comes from the root ‘favor’ (CHN).  You can’t have a right to a favor. You can’t have a right to ‘free’ anything. That would be a right to steal.

“every occupation, prospers by the aid which each receives from the other, and from the whole. Common interest regulates their concerns, and forms their laws; and the laws which common usage ordains, have a greater influence than the laws of government. In fine, society performs for itself almost every thing ascribed to government.” – Thomas Paine – “Rights of Man”

Don’t believe the mythology that, before the government interfered, everything was terrible. It was actually Better!

Before Medicare, Medicaid and Government regulation, Doctors understood they had a responsibility to the less fortunate and the Doctor provided free health care for the poor or neighbor paid for neighbor.  Fraternal Organizations provided the working poor with what today we call “Boutique Care”.   They paid a Doctor’s salary to service their members.  Since there were many doctors competing for this arrangement, fees were low.   The Fraternal Organizations also provided disability, health and life insurance.  At one point in the last Century over a quarter of all Americans belonged to fraternal organizations.

Soon the medical societies, like the AMA, who were cronies of the government and controlled the licensure of Doctors, imposed sanctions to discourage doctors from working for the fraternal organizations in order to raise the fees that Doctors could charge.  By making the requirements for licensing stricter, the number of doctors fell, competition dwindled and rates rose.  The final blow to fraternal doctors came with government imposed minimum fees.

Eventually, government Laws and regulations inflated the cost of medical services and imposed unreasonable liability standards to the point that offering “free” health care became too expensive.
People were driven into HMO’s who now decide what is “necessary”.
Government Laws forced employers to provide health care insurance, creating a problem for the unemployed and rules that stifle competition among Insurance companies increased insurance costs.

When the government, not the individual, pays, there is no incentive to compete on price of services.  In fact, the incentive for doctors is to raise prices as high as possible and do as many tests as possible to avoid lawsuits.
Medicare pays only a percentage of whatever is the “going rate”.  This rate is not market based.  It is set at a multiple of what Medicare will pay.  To get $394, the Hospital has to inflate the charge to $1,911.  If you don’t have insurance, you will be charged the inflated price, which they can not discount for you or they will be convicted of fraud, since they certified that the inflated price is the going rate.  Of course this is a ploy to get you on Insurance.
Claim
Advances in technology in other industries, where competition is allowed, have brought costs down significantly. Not so in Health care.
Patients and Doctors spend inordinate amounts of time wrestling with insurance companies.
and the Irony of ironies is that Neither the Patient nor the Doctors have any idea what anything costs.

It will only get much worse under Obamacare.

The solution is to get Government out of Health Care completely (other than the Attorney General to prosecute fraud and malpractice, CDC and maybe the FDA.)

Without the government, health care would be far more affordable, accessible and less confusing:
Health insurance should be inexpensive and for catastrophic illness not routine care.
With the current deductibles it is effectively that way anyway.
Why pay higher prices for government regulated blanket coverage that is unnecessary and overused.
Let the Fraternal and other organizations negotiate inexpensive health care for their members as they did before the government took over.

Eliminate Artificial Health Care prices by taking government intervention away (Medicare artificially raises prices for everyone).  Remove coverage of normal care and maintenance.   Remove price and wage controls and restore the ability of the Doctor to charge the market rate even if that is a LOWER rate for those that are poor.

Remove Government coverage requirements.  Restore the ability of insurance companies to offer less expensive policies that cover less.  Allow all competition across states and from foreign sources.

Insurance is for managing risk.   You buy insurance to cover unexpected high costs of major events beyond your control that could drain your finances.  Fire, floods or earthquakes that could destroy a house,  Automobile insurance and associated medical in case the car is wrecked or destroys property or injures you or someone else, disability insurance in case you become unable to work, unemployment insurance in case you lose your job, liability insurance in case of accidental damage or injury and Major Medical insurance to cover expensive treatments for major or chronic diseases like cancer, paralysis etc.  Insurance does not cover everything.  For the rest you are self-insured.

You don’t take insurance out to cover home maintenance like trimming the bushes or mowing the lawn.  You don’t take insurance out to cover automobile oil changes and service visits for normal wear and tear. You don’t take out insurance in case you sprain your finger at work or you don’t get a promotion.  In the same fashion, you don’t take out insurance to cover health maintenance and care for your body’s normal wear and tear.

You only take out insurance for unlikely events.  As long as the insurance covers unlikely events, the risk of payment by the insurance company can be spread out across a large enough population so that insurance can be offered to the customer at a very low price.

You don’t buy Pension insurance. You create a pension by putting aside some of your earnings. You lend that money out to investors and collect interest or you use it for investment yourself. You can do this yourself or through your employer.

The more risks you attempt to cover and/or the more risks that are probable that you cover, the more expensive the insurance.  Covering certainty with insurance is a contradiction in terms.  If it’s certain, you can’t insure against it happening.  You definitely will have to pay for it and it will be reflected in the price of the insurance.  Insurance manages risk.  If the risk is 100% the cost is at least 100% and there is no point to insurance.

Today’s Medicare and other health “insurance” that covers normal costs is a forced charity on those who pay combined with the receiver’s vain attempt to pay as little as they can for normal maintenance, and use as much health care as possible, at the expense of some other schmuck.

Covering normal maintenance, Doctor visits, shots and medication encourages unnecessary visits and led directly to the uneccessary and excessive prescribing of antibiotics that spurred today’s, drug resistant bacteria.  You can thank Medicare, President Johnson, and all the rest of the Politicians who supported this scheme over the years, for the “unintended consequence” of  killing hundreds of thousands of people that could, otherwise, have been saved.

Insurance companies and Medicare negotiate a discount to the suggested retail price for medical care.  If a person does not purchase health care insurance, they must pay the higher retail price.  Why?  Why can’t a provider charge a non-insured person the same lower price as the insured?   The insurance company doesn’t pay it, the patient does.  The provider can’t because of Crony regulations and a corrupt system.  It is a forced incentive to get healthy people to buy insurance. It is anti-competitive.  Insurance companies benefit from the healthy and the poor who can’t afford insurance are left without health care other than from voluntary or government-forced charity.

Creation Vs. Evolution Resolved (Humor)

Posted by in America

A boy asked his mom about their ancestry.  Mom spoke of her illustrious background, all the way back to the early Biblical figures.

"And where did they come from?"

"From Adam and Eve".

"And they"?

"G-d created them."

The boy wrote it down and then went to dad.

"Where do we come from?" asks the boy.

"Ah, we come from the apes. After millions years of evolution we evolved into humans."

The confused boy comes running back to his mom. "Mom, you said we come from Adam, Eve and G-d.

Dad says we come from the apes…"

"No contradiction here, son," she said. "I was talking about my side of the family."

There is no Bill of Rights

Posted by in America

The Bill of Rights is actually a Bill of Constraints.

The First ten amendments to the Constitution do not grant any rights. We are endowed with ALL rights by the Creator. The amendments are constraints put on the government to protect the States' and the people's rights.

They constrain the government:

  1. Not to make a state Religion or prohibit Free exercise of Religion, Free Speech, Free press, peaceful assembly or petition of the government.
  2. Not to infringe on the right of the people to keep and bear arms.
  3. Not to house soldiers without the owner's permission in peacetime and in war time only as proscribed by law.
  4. Not to search or seize people or property without a warrant based on an oath of probable cause and a description of the person or things.
  5. Not to hold any person to answer for capital or infamous crimes without indictment by grand jury except persons serving in the military in times of war or public danger. Not to put a person in jeopardy of life and limb twice for the same offense. Not to compel anyone to be a witness against themselves in any criminal case. Not to deprive anyone of life, liberty or property without due process of law. Not to take private property for public use without just compensation. [which is why income/wealth/estate tax used for government largess such as entitlements, Disaster aid, subsidies to industry, grants to states, education and other loans or any other service or program with no direct benefit or compensation to the tax payer is unconstitutional]
  6. In criminal prosecutions, ensure the accused a speedy public trial by an impartial jury from the state or district where the crime was committed and to be informed of the nature and cause of the accusation, confronted with the witnesses against the accused, have a compulsory process for obtaining witnesses in favor of the accused and to have counsel for the accused's defense.
  7. In common law suits for greater than 20 [of that time’s gold] dollars there remains a right to trial by Jury and no fact tried by a jury can be re-examined by another US court other than according to the rules of common law.
  8. Not to require excessive bail or impose excessive fines [why punitive damages over and above compensatory damages are unconstitutional] or inflict cruel and unusual punishment.
  9. Not to construe the enumeration of some rights in the Constitution as disparaging or denying any other rights retained by the people.
  10. The States or the People retain all powers not delegated to the United States [government] in the Constitution or prohibited to the States by the Constitution.

A hard Habit to break. (Humor)

Posted by in America
President Obama is standing outside the White House smoking a cigarette and rehearsing his next speech.

Suddenly his chief of Staff bursts out the door.

“Sir, you have to stop”  he says.

Obama looks at him and then his cigarette.

“Uh why the concern?” the President says quizzically.

“I’m worried this habit could kill you sir” he explains.

“I’m trying to quit you know” the President says with a sigh.

“Yes sir, and you have been pretty good about refraining for the last few months.  But now you’ve started again!”

After stubbing out his cigarette Obama says in his defense “It’s hard to break a 20 year old habit”  .

“Granted sir.  And that’s why I corrected your speech.”

“It’s God BLESS America sir not God DAMN America”.
